8. How to request access to a record
Your own personal information
Email motorosakhile@gmail.comwith the subject “Personal information request”. There is no charge. We may ask you to verify your identity first.
Any other record
- Complete Form 02 — Request for Access to Record(Regulation 7 of the PAIA Regulations, 2021), available from the Information Regulator’s website.
- Send it to motorosakhile@gmail.com, giving enough detail to identify the record, the form of access you want, and your contact details. If you are requesting on behalf of someone else, include proof of your authority.
- Pay the request fee of R140. This fee does not apply to requests for your own personal information.
- We will decide on your request within 30 days. We may extend this once by up to 30 days if the request involves a large number of records, and we will tell you if we do.
- If access is granted, an access fee may be payable for searching for, preparing and reproducing the record, in accordance with Annexure B of the PAIA Regulations, 2021. We may ask for a deposit before searching.
Grounds on which access may be refused
PAIA requires or allows a private body to refuse access in certain cases, including to protect: the privacy of a third party who is a natural person (section 63); a third party’s commercial or confidential information (sections 64 and 65); the safety of individuals and property (section 66); records privileged from production in legal proceedings (section 67); and our own commercial information (section 68). If we refuse access, we will explain why.
9. If you’re not satisfied
If your request is refused, or you disagree with a fee or extension, you may lodge a complaint with the Information Regulator or apply to court, within 180 days of being notified of the decision.
